MISDEMEANOR cases are those misdemeanor offenses that primarily do not involve traffic offenses. The majority of cases involve charges such as shoplifting, simple battery, bad checks, et cetera. All misdemeanor cases require a court appearance.

Information on a misdemeanor arrest case is not available through the Clerk’s Office until the case is officially filed and docketed with the Clerk by the Solicitor General’s Office. If there has been an arrest and no accusation filed with the Clerk the case will be in the Magistrate Court or the Solicitor General’s Office.

Once the accusation is filed with the Clerk, a misdemeanor case is scheduled for an Arraignment Hearing. Attorneys may, on behalf of their client, waive arraignment prior to the arraignment date by mail or in person on the 2nd floor of the Cobb State Court Building. At the Arraignment Hearing a defendant may plead guilty or not guilty.

As required by state law, dispositions of these cases are submitted to the Georgia Crime Information Center (GCIC) and when applicable, the Department of Driver Services (DDS).

The Clerk cannot issue a continuance for a Misdemeanor case. If you are requesting a continuance, contact the Solicitor General’s Office at (770) 528-8500.

Change of Address

It is the defendant’s responsibility to notify the court in writing of any change of address. Failure to do so could result in not receiving notification of a court date change, which could result in a bench warrant being issued for failure to appear.
